2A Talent Resource Referral Program Terms and Conditions

1. Eligibility:

  · The referral program is open to individuals who reside in the United States and follow the 2A Talent Resource LinkedIn page.

  · Employees of 2A Talent Resource and their immediate family members are not eligible to participate.

  · Ineligible Participants: Businesses, talent agencies, or other corporations are not eligible to participate in this referral program. Only individual referrals made by natural persons will be considered for the referral bonus.

  · Self-Referral Exclusion: Referrers are not eligible to receive a bonus for submitting their own application or resume. The referral bonus is intended for those who refer other candidates.

2. Referral Submission:

  · Referrals must be submitted HERE through the 2A Talent Resource website.

  · Referrals must include the full name, email address, and phone number of the candidate, as well as the referrer’s contact information.

3. Referral Bonus Criteria:

  · The referred candidate must be successfully hired by one of our clients and remain employed for a minimum of 90 consecutive days.

  · The $500 gift card bonus will be issued to the referrer within 30 days after the candidate completes the 90-day employment period.

                 o Gift cards will be delivered by either USPS, UPS, or FedEx to a valid street address. Please note that PO Box addresses are not eligible for delivery.

                 o 2A Talent Resource, LLC is not responsible for lost or stolen gift cards, and they will not be replaced.

4. Multiple Referrals:

  · If the same candidate is referred by multiple people, the bonus will be awarded to the person who submitted the referral first, as determined by the timestamp of the referral submission.

  · In the event of simultaneous submissions, the bonus will be evenly split among the referrers.

5. Referral Limits:

  · Each referrer is limited to earning a maximum of two referral bonuses within any six-month period. Additional referrals during this period will not be eligible for the bonus until the next six-month cycle.

6. Verification Criteria:

  · Referrers must provide valid contact information, including full name, phone number, and email address.

  · 2A Talent Resource reserves the right to verify the identity of the referrer using methods such as confirming LinkedIn profile details, requesting additional identification, or contacting the referrer directly.

  · The referrer will be required to provide proof of U.S. residency to receive the bonus.

7. Fraudulent Behavior:

  · Any attempt to manipulate, falsify, or otherwise fraudulently participate in the referral program will result in immediate disqualification from the program.

  · If fraudulent behavior is discovered after a bonus has been issued, 2A Talent Resource reserves the right to reclaim the bonus and pursue legal action if necessary.

  · Disqualified participants are banned from future participation in 2A Talent Resource programs and promotions.

8. Residency Requirement:

  · The referrer must be a legal resident of the United States to be eligible for the bonus.

9. Tax Implications:

  · The $500 gift card bonus may be considered taxable income. The winner is responsible for any and all applicable taxes associated with the receipt of the gift card.

  · A 1099 form will be issued to the winner if the total amount of referral bonuses and other payments received from 2A Talent Resource within the calendar year exceeds $600.

  · Before the bonus is issued, the winner must provide the following personal information to ensure that a 1099 form can be processed and mailed:

                 o Full legal name

                 o Social Security Number (SSN) or Taxpayer Identification Number (TIN)

                 o Current mailing address

                 o This information must be provided by completing IRS Form W-9.

                 o 30-Day Submission Requirement: Winners have 30 days from the date they are notified of their win to provide the necessary tax information. Failure to provide the required information within this timeframe will result in forfeiture of the referral bonus.

  · Confidentiality: 2A Talent Resource is committed to maintaining the confidentiality and security of all personal information provided. The information collected will be used solely for the purpose of tax reporting and will be handled in accordance with our Privacy Policy.

10. Program Duration:

  · This referral program is valid from September 1, 2024, through October 31, 2024. All referrals must be submitted by 11:59 PM PST on December 31, 2025.

11. Program Changes:

  · 2A Talent Resource reserves the right to modify, suspend, or terminate the referral program at any time without prior notice. Any changes will be posted on our website.

12. Disqualification:

  · 2A Talent Resource reserves the right to disqualify any referrer or referred candidate if there is evidence of fraudulent or unethical behavior.

13. Privacy:

  · By participating in the referral program, the referrer consents to the use of their name and contact information for purposes related to the referral program. The information provided will be handled in accordance with our Privacy Policy.

14. Limitation of Liability:

  · 2A Talent Resource is not responsible for any technical issues, loss of submissions, or other problems that may prevent a referral from being successfully submitted or processed.

15. Governing Law:

  · These terms and conditions are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. By participating in the referral program, you agree that any disputes or claims arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts located in Kentucky. This choice of law does not preclude the applicability of mandatory consumer protection laws in the state where you reside.

16. Arbitration Clause:

  · Any dispute, controversy, or claim arising out of or relating to this referral program, including the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in accordance with its rules. The arbitration shall take place in Boston, Massachusetts, and the language of the arbitration shall be English. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

  · By participating in the referral program, you agree to waive your right to a trial by jury or to participate in a class action.
